CONTEST DATES:The "G FUEL SMS Notification Registration Giveaway" (the "Sweepstakes") begins at 00:00. M., Eastern Time ("ET") on March 27, 2023 and ends at 11:59 p.m. M. ET on April 27, 2023 (the "Sweepstakes Period"). Entries received outside of the drawing period that fail to comply will be disqualified. The Website (defined below) and Instagram timestamps are the official timekeeping tools for this Sweepstakes.
AUTHORIZATION:The Sweepstakes is open to lawful permanent residents of the continental United States and the District of Columbia who, at the time of entry (each, an Entrant). Entrant selected as the potential Grand Prize winner (el "Ganador del gran Prize") must have a clear , personal and valid Social Security Number for Sponsor (defined below) to inform the tax responsibility associated with acceptance of the Gran Premio ("Grand Prize"). Valid Social Security numbers are determined by Internal Revenue Service ("IRS") requirements, as defined in the “PRIZE CLAIMS” section of these Official Rules Employees and their immediate family members (parent, child, sibling or spouse, regardless of where they live, or persons living in the same household, whether related or not) of Sponsor and everyone its parents, divisions, affiliates, subsidiaries, distributors, advertising and promotions agencies and any other person involved in the development, production, operation or distribution of this Sweepstakes including, but not limited to, National Sweepstakes Company, LLC (the "Independent Administrators") and the companies providing the prizes contained herein (all of the foregoing collectively referred to as "Sweepstakes Companies") are not eligible to enter. Sweepstakes are subject to all federal, state and/or local laws and regulations and are available in Alaska, Hawaii, Puerto Rico and other US territories and possessions outside the continental United States and the District of Columbia and wherever are prohibited or restricted, void law.
ACCORDING TO THE OFFICIAL RULES:Participation in the Sweepstakes constitutes Entrant's full and unconditional acceptance and acceptance of these Official Rules and the decisions of Sponsor and the Independent Administrator, which are final and binding. Eligibility to win a prize is conditional upon timely completion of all requirements set forth in these Official Rules.
HOW TO PARTICIPATE:In order to participate in the raffle, the participant must be a registered user of Instagram. Entrant's Instagram profile setting must be set to "public" for Sponsor to view in order to determine the winner. If the entrant's account is not set to "public," Sponsor may not be able to verify the entry and entrant may not be eligible to win. Entrants cannot use multiple Instagram accounts to enter.
There are two (2) ways to enter the Sweepstakes; (a) SMS registration; or (b) the alternative method of entry by mail ("AMOE").Regardless of the method used to enter the Sweepstakes, entry per Entrant is limited to one (1) entry during the Sweepstakes Period.
- Subscribe to SMS: To enter via SMS, visit Sponsor (@GFuelEnergy) on Instagram during the Sweepstakes Period and follow the link in Sponsor Stories to sign up for SMS alerts. The link will be posted to Stories daily during the drawing period. so visitgfuel.comand sign up to receive email notifications from GFUEL by submitting your email address and clicking the "Continue" button. By completing these two (2) tasks, the entrant will receive one (1) entry into the Sweepstakes. You need to register to receive SMSjEmail notifications to receive sweepstakes entries via this method.
- Alternate Input Method (AMOE):To enter the sweepstakes without registering for SMS and email alerts, you can email.On a 3" x 5" card, print or handwrite legibly your first name, last name, address, city, state, zip code, phone number (including area code), date of birth, and email address. Mail your completed 3" x 5" card in an envelope to G FUEL SMS Notification Sign Up Giveaway, 100 Wireless Blvd, Hauppauge, NY 11788. Mail submissions must be in by April 27, 2023 and by the Received May 4, 2023. be considered eligible in 2023. Each envelope counts as one (1) entry into the Sweepstakes. Entries submitted or completed by anyone other than the entrant will be void. Mechanical reproductions will not be accepted. Sponsor will not verify receipt of entries. All entries submitted by mail become the sole property of Sponsor and will not be returned. Sponsor is not responsible for lost, late, misdirected, illegible or damaged entries.
Limit of one (1) entry per entrant.Any attempt by an entrant to enter more than the specified number of entries through the use of multiple/different email addresses, identities and/or other methods will void all entries for that entrant.
Entrant understands and agrees that Sponsor and Sweepstakes Companies are not responsible for lost, late, misdirected, inaccessible, non-visible or undeliverable Entries, whether due to ; (a) system error, omission, interruption, deletion, defect, delay, theft or destruction; (b) failed, erratic, incomplete or distorted computer or telephone transmissions or other telecommunications failures, hardware or software failures of any kind; (c) lost or unavailable network connections, typographical or system errors and failures, technical or other failures. Each Entry will be reviewed and approved by Sponsor and may be disqualified if not submitted in accordance with these Official Rules. The Independent Sponsor/Administrator reserves the right to disqualify any entry it deems inappropriate in any way. Submissions made after the deadline or otherwise than stated above will not be accepted. If an entry violates these restrictions, that entry will be disqualified and ineligible to win. In such event, Sponsor and the Independent Administrator further reserve the right to take any action necessary to protect their respective legal rights.
WINNER/NOTIFICATION:By May 5, 2023, one (1) Grand Prize Winner will be selected from all eligible Entries received during the Sweepstakes Period. The random drawing will be conducted by Sponsor, whose decisions will be based in its sole discretion and interpretation of these Official Rules and will be final and binding in all respects. Odds of being selected as a Grand Prize Winner depend on the total number of Entries received during the Sweepstakes Period.
The potential grand prize winner will be notified by Sponsor via their Instagram account within one (1) to three (3) business days of the date the winners were selected. The potential grand prize winner must provide their email address and shipping address for delivery of the applicable prize. In addition, the potential Grand Prize winner must provide their email address and shipping address for delivery of the applicable prize and complete the PRIZE CLAIM process described below. Sponsor will make only two (2) attempts to contact the potential Grand Prize Winner via Instagram. In the event Sponsor is unable to contact a potential Prize Winner after two (2) attempts, the original potential Grand Prize Winner will be disqualified and an alternate Prize Winner (selected at random from the remaining eligible non-winning entries received during the Period Draw) will be notified until the correct number of winners is confirmed.
The Grand Prize will be shipped within four (4) weeks or less from the date the Grand Prize winner was determined and verified. The Grand Prize Winner's name may also be posted on Sponsor's website and/or social media channels.
PRICE CLAIMS:Except where prohibited, the potential Grand Prize Winner must complete, sign and return an Affidavit of Authorization, Liability and Publicity Release (the “Release”) and an IRS Form W-9 (“Form W-9”) and others from Sponsor requested documents (collectively, the "Required Documents") within seven (7) days or less of receipt of the Independent Administrator's email notice. If a potential Grand Prize Winner fails to return the required documents within the required timeframe, or if the email is returned as undeliverable, such potential Grand Prize Winner will forfeit the applicable prize and a replacement will be notified as described in the WINNER/NOTIFICATION section above, as well if the name of the potential winner of the disqualified grand prize has been publicly announced.Potential grand prize winners must report income to the IRS. If during the verification process it is determined that the potential grand prize winnerdoes not have a valid, personal, unique Social Security number for Sponsor to report tax liability associated with acceptance of the applicable prize, such potential Grand Prize winner will be disqualified and an alternate will be notified as described above. Valid social security numbers are determined by IRS requirements.If the Independent Sponsor/Administrator, in its sole discretion, determines that a Grand Prize winner is ineligible or otherwise complies with these Official Rules, the potential Grand Prize winner will forfeit the applicable prize and a replacement will be notified as described. NOTIFICATION above, even if the name of the potential winner of the disqualified grand prize has been publicly announced. In the event that a potential Grand Prize Winner is disqualified for any reason, the Independent Sponsor/Administrator will have no responsibility or liability to that person.
AWARDS:One (1) Grand Prize will be awarded in this Sweepstakes. Grand Prize Approximate Retail Value (“ARV”) is $1,031.97, which includes one (1) GFUEL Mini Fridge (MSRP $499.99), one (1) Sony PS5 (MSRP $499.99) and one (1) Includes pack of GFUEL Variety Cans (MSRP $31.99).
General Prize Details and Restrictions: No more than one (1) prize will be awarded. All expenses associated with the prize, including but not limited to any federal, state and/or local taxes, are the sole responsibility of the winner. The prize consists of the items listed in this document. Sponsor makes no representations or warranties as to any potential benefits or results to any winner in connection with any prize. ALL PRIZES ARE PROVIDED "AS IS" AND SPONSOR MAKES NO REPRESENTATIONS, WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, ACTUAL OR STATUTORY, REGARDING ANY PRIZE (NOR IS LIABLE FOR THEM), AND ALL SUCH WARRANTIES ARE DISCLAIMED.
NOWinner may assign or transfer a prize to another person. No substitution, exchange, redemption, transfer or exchange of prizes is permitted, except in Sponsor's sole and absolute discretion. Prizes in kind cannot be substituted or exchanged for cash. All prices are subject to availability and subject to change. If a prize or portion of a prize cannot be awarded due to circumstances beyond Sponsor's control, an alternative prize may be awarded;offered,Althoughthat if prizes are awarded but not claimed or forfeited by the winner, such prize may not be reinstated in Sponsor's sole and absolute discretion. Prizes may only be redeemed and accepted by the respective prizewinner. Prizes will only be awarded if properly claimed in accordance with these Official Rules. Other restrictions may apply.
All taxes, fees and surcharges associated with a prize are the sole responsibility of the prizewinner and may be subject to an appropriate withholding tax.
TERMS AND CONDITIONS:Sponsor reserves the right, in its sole discretion, to disqualify any person or entity found to be tampering with the entry process or the operation of the Sweepstakes, or in violation of these Official Rules. Any attempt by any person to interfere with the lawful operation of the Sweepstakes may be a criminal or civil violation, and if such an attempt is made, Sponsor reserves the right to recover damages from that person to the extent permitted by law . The Independent Sponsor/Administrator's failure to comply with any provision of these Official Rules due to acts of God, hurricane, war, fire, riot, earthquake, terrorism, public enemy, acts of governmental authorities beyond the Independent Sponsor/Administrator's control, or otherwise Cases of "Force Majeure" shall not be considered a violation of these Official Rules. In the event that the operation, security or administration of the Sweepstakes is compromised in any way for any reason, Sponsor may, in its sole discretion, (a) suspend the Sweepstakes to remedy the impediment and then individually resume the Sweepstakes - in a manner that best conforms to the spirit of these Official Rules, or (b) cancel the Sweepstakes and, in Sponsor's sole discretion, award prizes to entrants from eligible Entries received on a "Winner/Notification " of these Official Rules. Independent Sponsor/Administrator's failure to enforce any provision of these Official Rules will not constitute a waiver of such provision. The Released Parties (as defined below) are not responsible for lost, late, misplaced, undeliverable, or incomplete Submissions, whether due to System errors or failures, faulty transmissions or other telecommunications failures, Submissions received due to hardware or software failures of any kind, interrupted network connections, unavailable, unsuccessful, incomplete or distorted computer or telephone transmissions, typographical or system errors and malfunctions, technical Errors related to the Sweepstakes, including but not limited to Sweepstakes administration, processing of entries, selection of Sweepstakes winners, announcement of winners or in other Sweepstakes-related materials.
In the event of a dispute as to who submitted a Submission, the Submission will be deemed to have been submitted by the authorized account holder (defined below) from the email address or social media account provided at the time the Submission was made. “Authorized Account Holder” is defined as the natural person who receives an email address from an ISP, online service provider, or other organization (e.g., a business, educational institution, etc.) that is responsible for assigning the E -mail address is responsible. -Email addresses for the domain associated with the submitted email address or natural person associated with the social media account. An Entrant may be required to verify to Sponsor that Entrant is the authorized account holder of the email address or social media account associated with the Entry. THE FOREGOING EXPRESSLY INCLUDES, BUT IS NOT LIMITED TO, ANY ATTEMPT TO ALTER OR MANIPULATE THE PUBLIC VOTING STAGE OF THE SWEEPSTAKES.
DISCLAIMER AND LIMITATIONS OF LIABILITY:By entering the Sweepstakes, Entrant agrees to indemnify and hold harmless Sponsor, Sweepstakes Entities, Instagram, their officers, directors, employees and agents (the “Released Parties”) from and against any claim or cause of action made against them arising out of participation in the Sweepstakes or receipt or use of any prize (if any), including but not limited to: (a) unauthorized human interference with the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) typographical errors; (d) errors in the administration of the Sweepstakes or the processing of entries or votes; (e) false or inaccurate information; (f) inability to access Sponsor's website; (g) Entries that are processed late or incorrectly, or that are incomplete or lost due to computer or electronic malfunctions or traffic congestion on the Internet or any website; and/or (h) injury or damage to any person or property that may be caused directly or indirectly, in whole or in part, by entrant's participation in the Sweepstakes or receipt of a prize by entrant or use of entered entries and attributes, including , without limitation, claims of invasion of privacy, right of publicity, slander, slander, or other consideration. Entrant further agrees that in any event Sponsor's liability shall be limited to the cost of registering and participating in the Sweepstakes and in no event shall Sponsor be liable for attorneys' fees.
WITHOUT RESPONSIBILITY:By entering, Entrants agree to indemnify, hold harmless, Sponsor, Sweepstakes Entities, Instagram and each of their respective officers, directors, employees, agents and representatives from and against any and all claims by Winner, Entrants or others indemnify and hold harmless any other third party connected in any way with the operation of this Sweepstakes and any other claim, damage or liability arising out of injury, damage or loss to any person (including death) or property of any kind whatsoever, arising out of or in party, directly or indirectly, in the acceptance, possession, misuse or use of any prize or participation in any activity related to or participation in this Sweepstakes.
APPLICABLE LAW AND LOCATION:Any dispute arising out of these Rules or this Sweepstakes will be settled by and subject to the Rules of J.A.M.S. in binding arbitration in Suffolk County, New York and before a jointly selected arbitrator with experience in the US television and Internet entertainment industries. Both Entrant and Sponsor further agree to waive the right to have your claims heard by a jury and the ability to seek representation in a class action or otherwise to represent others other than you and Sponsor. The only exceptions to this are that (a) each of you and Sponsor retain the right to sue in small claims court; and (b) each of you and Sponsor may take legal action against the other to prohibit the infringement or other misuse of intellectual property rights.
These Official Rules are deemed to be entered into and construed in accordance with the laws of the State of New York and the United States that apply to agreements negotiated, conducted and performed in that state. Any suit, action or dispute arising out of these Rules will be brought and prosecuted only in the State of New York. You consent to the jurisdiction of the state courts of New York and the federal courts located in Suffolk County in any matter arising out of or relating to these Official Rules and you agree that Suffolk County, New York shall be a suitable venue.
Except for any dispute resolved by arbitration pursuant to the Arbitration Agreement above, you and Sponsor agree to submit to the exclusive jurisdiction of the courts located in Suffolk County, New York, to resolve any disputes arising out of such officers, to be attached Rules or services or products provided by Sponsor. YOU ACKNOWLEDGE, VOLUNTARILY AND INTENTIONALLY WAIVE ANY RIGHT TO A JURY TRIAL WITH RESPECT TO ANY DISPUTES (INCLUDING ANY CLAIM, CLAIM, COMPLAINTS OR THIRD PARTY COMPLAINTS) ARISING OUT OF, UNDER OR CONNECTED WITH THESE RULES.
YOU AGREE THAT ANY CAUSE OF ACTION YOU MAY HAVE ARISING OUT OF OR IN CONNECTION WITH THESE OFFICIAL RULES, SPONSOR SITES OR SERVICES MUST BE ADDRESSED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ARISES. AFTER THAT PERIOD, THIS ORDER CAUSE WILL BE PERMANENTLY INVALID.
PRIVACY POLICY: Any non-public personal information you provide to Sponsor is subject to Sponsor's Privacy Policy, which is posted athttps://gfuel.com/pages/privacy-policy. By entering this Sweepstakes, you consent to Sponsor sharing your email address and any other non-public personally identifiable information used for entry with a co-sponsor for the purpose of administering and delivering the prize. Sponsor will not sell, rent, transfer or disclose your Personal Information to any third party, except as previously described in this document or Sponsor's Privacy Policy.
